Terms of Service

1. Acceptance of Terms
By accessing or using Your Personal Stories (“YPS,” “we,” “our,” or “us”), including our website, mobile applications, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time; continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
YPS provides a digital platform for recording, preserving, and sharing personal life stories through video recordings, photo albums, family trees, biographies, QR memorial codes, and related features. The Service includes free and paid subscription tiers with varying feature sets and storage limits.
3. Account Terms
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.
You must be at least 13 years old to create an account. Users between the ages of 13 and 18 must have verifiable consent from a parent or legal guardian, which is administered through our Family Plan. Parents and guardians who add a minor through the Family Plan are responsible for that minor’s use of the Service and may manage the minor’s account, communication permissions, and content.
4. Subscriptions & Billing
- Plan tiers. The Service is offered as a Free tier and paid subscription tiers (including, but not limited to, Premium and Family plans). Each tier’s price, features, and storage allowance are described on our Pricing page at the time of purchase.
- Billing cycle. Paid subscriptions are billed in advance on a recurring monthly or annual basis, depending on the plan you select. Payments are processed by our third-party payment processor, Stripe; we do not store your full card details.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on each renewal.
- Cancellation. You may cancel auto-renewal at any time from your account billing settings or by contacting us. Cancellation stops future charges; your paid features remain active until the end of the current billing period.
- Refunds.Except where required by applicable law, subscription fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused features. If you purchased a subscription through the Apple App Store or Google Play, refund requests are governed by that store’s policies and must be submitted to the respective store.
- Price changes. We may change subscription prices. We will give you advance notice of any price change, which will take effect on your next renewal after the notice period.
5. Content Ownership & License
You retain ownership of all content you upload to the Service, including videos, photos, text, stories, and family data (“User Content”). By uploading User Content, you grant YPS a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely for the purpose of operating and providing the Service to you and the recipients you designate. This license ends when you delete your User Content or close your account, except for content that has already been shared with others or that we must retain to comply with law.
The YPS platform itself — including its design, code, features, and branding — is owned by YPS and protected by intellectual property laws. You may not copy, modify, reverse-engineer, or distribute any part of the platform without our prior written consent.
6. Acceptable Use
You agree not to use the Service to:
- upload, post, or transmit any content that is illegal, infringing, defamatory, obscene, or otherwise objectionable;
- harass, threaten, abuse, or harm another person, including other family members or minors;
- impersonate any person or entity, or misrepresent your affiliation with a person or entity;
- upload content you do not have the right to share, or that violates the privacy or intellectual-property rights of others;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with the Service’s operation.
We may remove content or suspend accounts that violate this section. There is no tolerance for objectionable content or abusive behavior, and confirmed violations may result in immediate termination.
7. Executor Access
The Service allows you to designate one or more trusted individuals as an “Executor” who may access your account in the event of your death or incapacity, consistent with your stored wishes. An Executor’s access takes effect only after our verification process is completed.
An Executor may view, download, and preserve the User Content and memorial pages you have made available to them, and manage the public memorial of the account holder. An Executor may notchange account ownership for their own benefit, make new purchases in your name beyond maintaining the account, alter your billing details for unrelated purposes, or use your User Content for any purpose other than honoring and preserving your stories. You are responsible for choosing an Executor you trust; YPS is not liable for an Executor’s actions.
8. Limitation of Liability
To the maximum extent permitted by law, YPS and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
9. Termination
You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We will retain your User Content for a reasonable period to allow you to export your data, after which it may be permanently deleted.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. If any provision is found unenforceable, the remaining provisions continue in full force and effect.
